Photo/Video Release Form

  1. Grant of Rights
    I hereby grant Funtilla Co. d/b/a MagTide ("Company") the absolute, perpetual, and irrevocable right and permission to record, photograph, film, or otherwise capture my name, image, likeness, appearance, voice, statements, and/or performance ("Recordings") in any format, including but not limited to video, photography, and audio.
    This Release applies to all Recordings created by or on behalf of the Company on or after the date of this Agreement, including any current and future photography, videography, audio recording, promotional, marketing, product demonstration, event, or other media sessions, unless otherwise agreed to in writing by the Company.
  2. Ownership and Use
    I acknowledge that all Recordings are the sole property of the Company. To the extent I possess any rights in the Recordings, I irrevocably assign to the Company all rights, title, and interest I may have in the Recordings, including any applicable copyright or other intellectual property rights. The Company may use, reproduce, edit, modify, publish, distribute, display, transmit, license, and otherwise exploit the Recordings, in whole or in part, worldwide, in perpetuity, and in any media or format now known or later developed, for any lawful purpose, including but not limited to advertising, marketing, publicity, promotion, social media, websites, print materials, educational materials, product packaging, and commercial or editorial purposes.
  3. Waiver and Release
    I waive any right to inspect or approve the finished Recordings or their use. I release and forever discharge the Company, its owners, officers, employees, contractors, agents, affiliates, successors, licensees, and assigns from any and all claims, demands, causes of action, damages, or liability arising out of or relating to the creation or use of the Recordings, including, without limitation, claims for defamation, invasion of privacy, infringement of publicity rights, or moral rights.
  4. No Compensation
    I acknowledge and agree that I am not entitled to, and will not receive, any payment, royalty, compensation, or other consideration for granting this Release or for the Company's use of the Recordings.
  5. Representations
    I represent that I am at least eighteen (18) years of age and have the legal authority to enter into this Agreement. If I am signing on behalf of a minor, I represent that I am the minor's parent or legal guardian and have the legal authority to execute this Release on the minor's behalf.
  6. Governing Law
    This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.
  7. Entire Agreement
    This Agreement constitutes the entire understanding between the parties concerning the subject matter herein and supersedes all prior oral or written agreements relating to the Recordings. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
